TERMS OF USE OF THE PITCHTY PLATFORM FOR CANDIDATES

Article 1 – Introductory provisions and description of the service

1.1 Introductory provisions

These terms of use (hereinafter the “Terms”) govern the rights and obligations of individuals who register on the PITCHTY platform (hereinafter the “Platform”) as job candidates (hereinafter the “candidate” or “you”) and of the operator of the Platform, MyEnterprise 9 s.r.o., Company ID No.: 24006475, with its registered office at Sokolova 719/2, Karlín, 186 00 Praha 8 (hereinafter the “Operator” or “we”).

1.2 Description of the service

PITCHTY is a recruitment platform whose core principle is sharing a short, 30-second video introduction (hereinafter a “pitch”) instead of a traditional CV. Candidates create a profile in the mobile application, with the pitch as its central element. Making the profile and pitch available to employers and sending contact requests are governed by Article 3.2. The Platform is available and operated exclusively within the Czech Republic.

The Platform only facilitates establishing contact between a candidate and an employer and does not guarantee employment or a response from an employer. The Operator is not the candidate’s employer, a recruitment agency acting on behalf of an employer, or a party to any employment, civil-law or other relationship that may arise between a candidate and an employer.

Use of the Platform is free of charge for candidates.

Article 2 – Registration, candidate account and age restriction

By completing registration and accepting these Terms, you enter into an agreement with the Operator for free use of the Platform.

2.1 Age restriction

Only individuals who have reached the age of 15, completed compulsory schooling and are entitled to work in the Czech Republic may use the Platform. By registering, you confirm that you meet these conditions.

The Operator may request proof of a candidate’s age and may restrict or terminate access to the Platform if there are reasonable grounds to suspect that the age requirement is not met.

2.2 Registration method

Candidates register and sign in using an email address and password or through a supported external sign-in provider.

2.3 Required registration details

When creating a candidate account and profile, you provide the following required information:

  • email address;
  • display name;
  • date of birth, which is not displayed to employers;
  • confirmation of your entitlement to work in the Czech Republic;
  • telephone number;
  • preferred location (a region of the Czech Republic);
  • video introduction (pitch) – required for publication of the profile (see Article 3).

The information provided during registration and in your profile must be truthful, complete and up to date. If any information that you can edit on the Platform changes, you must update it without undue delay.

2.4 Account security

Your account is intended solely for your personal use. You must not allow another person to access your account or use another person’s account.

If you discover or reasonably suspect misuse of your account or of sign-in through an external provider, or unauthorised access to your account, you must immediately notify the Operator through the contact point specified in Article 12. The Operator will take reasonable measures to secure the account; in particular, it may temporarily restrict the account until the suspicion has been thoroughly investigated.

Article 3 – Candidate profile and video introduction (pitch)

3.1 Pitch

The pitch serves to introduce a candidate to employers before a contact request is sent.

3.2 Profile visibility and contact details

Once approved by a moderator, the basic profile, including an abbreviated name, regions, profile information and a video thumbnail, is available to signed-in authorised users of active company accounts even without a subscription. Before a contact request is approved, an employer sees the first name and the initial of the surname (e.g. Jan N.); if the name consists of a single word, only that name is displayed. The video thumbnail may show your face. The display name is not an officially verified identity, and abbreviating the name does not guarantee that the profile is anonymous.

Playing the pitch and sending new contact requests require an active subscription, including any trial period. The disclosure of contact details and the full display name is governed by Article 4.2.

After the subscription ends, previously approved contacts and history remain available to the employer on a read-only basis.

3.3 View statistics

In the application, you can see aggregate statistics showing how many times your profile has been viewed.

3.4 Pausing and reactivating a profile

You can pause your profile in Settings without deleting your account. A paused profile will no longer appear in search results, via a shared link or in the usual overview of selected candidates (shortlist). An employer cannot newly add it to a shortlist or send you a new contact request. Pausing a profile does not remove existing shortlist entries.

You may approve or reject pending contact requests even while your profile is paused; pausing does not change the time limit for responding to them under Article 4.1. Until a request is approved, the employer can see its status; merely sending a request does not give the employer access to the paused profile or video. If you approve a request while your profile is paused, that employer gains access to the profile and contact details to the extent specified in Articles 3.2 and 4.2.

Employers whose contact requests you have already approved retain access to your profile and the disclosed information; playing the pitch continues to require the relevant permissions and an active subscription. Once reactivated, the profile is available again under the conditions in Article 3.2; contact requests that have already expired are not reinstated. Account deletion and its effects are governed by Article 10.1.

Article 4 – Contact requests from employers

4.1 Sending and responding to a contact request

If an employer wishes to contact you, it may send you a contact request through the Platform. The request includes the employer’s profile and a text message.

You may approve or reject a contact request, or leave it unanswered. If a request is not answered within 30 days of its delivery, it expires automatically; the Platform will notify you 48 hours before it expires. You may reverse your rejection of a request within 48 hours of rejecting it.

4.2 Approval of a request and disclosure of contact details

By approving a contact request, your contact details (telephone number and email address) and the full display name you entered will be disclosed only to the employer that sent you that specific request. Subsequent communication between you and the employer takes place outside the Platform.

Approving a contact request does not constitute acceptance of a job offer, conclusion of an employment contract or the creation of any other legal relationship between you and the employer.

Article 5 – Content rules

5.1 Candidate’s responsibility

You are solely responsible for all content you publish on the Platform, in particular the information in your profile and your video. Content must be accurate, must not be misleading or deceptive, and must comply with these Terms and applicable law.

In particular, you are responsible for having all rights and permissions necessary to upload, make available and use the content you submit to the Platform, including rights to any music, photographs, graphics, videos, audio recordings or recordings of third parties used.

At the Operator’s request, you must cooperate and provide evidence that you are authorised to use such content where this is necessary to protect the rights of the Operator, another user or a third party, or to deal with a notice or claim relating to your content.

If you are at fault for a breach of an obligation under these Terms or applicable law and thereby cause damage to the Operator, you are liable for that damage to the extent prescribed by law. The Operator may seek compensation for damage actually incurred and demonstrable, including costs reasonably incurred in dealing with a justified third-party claim, if that claim arose as a result of your breach of obligations.

5.2 Prohibited content

In particular, the Platform prohibits publishing content that:

  • contains nudity or sexually explicit visual material, or other content clearly inappropriate for a working environment;
  • contains grossly inappropriate or offensive language incompatible with the purpose of the Platform;
  • contains any advertising or commercial communication or promotion of products, services or third parties;
  • includes contact details (email addresses, telephone numbers, social media profiles, website addresses, etc.) or the candidate’s full name directly in the video or in profile fields not intended for that purpose;
  • impersonates another person or contains information about a third party without their consent;
  • is unlawful or incites unlawful conduct, including content inciting hatred, discrimination or violence;
  • infringes third-party intellectual property rights (copyright in music, photographs, videos, etc.);
  • contains false or misleading information about the candidate’s qualifications, work experience or identity;
  • is contrary to applicable law, good morals, the purpose of the Platform or the legitimate rights and interests of the Operator, employers or third parties.

5.3 Requirements for the video introduction

The video introduction must meet the Platform’s basic technical and formal requirements. In particular, a video may not be approved if its sound or image is insufficiently clear, the lighting is inadequate, the candidate’s face is not clearly visible, more than one person appears in the frame, or a technical problem or failure to meet video length or format requirements is identified after upload.

5.4 Anti-discrimination aspects of the video format

The video introduction may reveal your physical characteristics, age, ethnic origin or other personal characteristics. In its terms for employers, the Operator expressly prohibits discrimination in the selection of candidates on the basis of such characteristics, in accordance with the Anti-Discrimination Act (Act No. 198/2009 Coll.) and the Labour Code (Section 16). The pitch is intended to supplement your professional competencies, rather than serve as the sole criterion for a decision.

Article 6 – Content moderation

6.1 Human review before publication

Every profile and video introduction is reviewed by a human moderator before its first publication. We notify you of the moderation outcome by email or push notification.

Moderation primarily serves to check whether content clearly breaches these Terms, third-party rights or applicable law, and whether the video introduction (pitch) meets the requirements in Articles 5.2 and 5.3 of these Terms. However, moderation does not constitute verification of the accuracy of every detail provided by a candidate or a guarantee that the candidate is suitable for a particular position or employer.

6.2 Operator’s authority to take action concerning content

The Operator may:

  • reject content and decline to publish it if it finds that the content does not meet the requirements set out in these Terms or is contrary to applicable law;
  • remove content or disable access to it if it is published in breach of these Terms or violates applicable law;
  • temporarily restrict the availability of content while investigating a notice concerning objectionable content.

6.3 Statement of reasons for taking action

If we refuse to publish, remove or otherwise restrict your content, we will provide you with a specific and understandable reason for the decision without undue delay, by email or push notification.

Depending on the circumstances, the notice will include, in particular, the type of measure taken, its duration, the reason for the decision, a reference to the relevant provision of these Terms or applicable law, and information about the possibility of submitting an objection.

6.4 Objection to a moderation decision

You may submit an objection to a decision refusing publication, removing content or restricting content, free of charge, through the contact point for users specified in Article 12, within 10 days of being notified of the decision.

Article 7 – Reporting illegal content

You may report content you consider illegal to the Operator electronically at info@pitchty.com. This option is available to any individual or legal entity without having to register on the Platform.

A notice of illegal content should include a sufficiently substantiated explanation of why the person submitting the notice considers the content illegal; a precise indication of its location on the Platform, in particular a URL, profile or pitch identifier, or other information enabling it to be located unambiguously; the name of the individual or entity submitting the notice and their email address, unless an exception is provided by law; and a statement that the person submitting the notice believes in good faith that the information provided is accurate and complete.

The Operator will acknowledge receipt of the notice without undue delay, assess it in a timely, objective, non-arbitrary and diligent manner, and inform the person submitting it of its decision, any use of automated means and the available means of redress.

The same email address may also be used to report content that is not illegal but may breach these Terms. Such notices will be assessed under the Platform’s rules.

Article 8 – Content licence and intellectual property

By uploading your profile and video introduction to the Platform, you grant the Operator a non-exclusive, royalty-free licence to store, display and technically optimise your content, make necessary technical copies, convert it into suitable technical formats and quality levels, create thumbnails, stream it and make it available to registered employers for the purpose of operating the Platform, for the duration of your registration. Removal of the video and retention of related data after account deletion are governed by Article 10.1.

The licence under the preceding paragraph is granted only to the extent necessary to operate, secure, moderate, technically process and make content available within the Platform. The Operator is not authorised to use your pitch for marketing or advertising outside the Platform.

All rights to the Platform itself (software, graphics, trademarks and the PITCHTY trade name) belong to the Operator or to persons who have granted it the relevant licence. Their use without the Operator’s consent is prohibited.

Article 9 – Processing of personal data

Information about the processing of personal data and your rights is set out in the Privacy Policy.

Article 10 – Account deletion; inactive accounts and their erasure

10.1 Account deletion

You may request deletion of your candidate account and profile at any time in the application settings or by email.

Immediately after a request to delete a candidate account is accepted for processing, your profile will be blocked and will no longer be available to employers. No new contact requests can be sent to you, and pending contact requests will be cancelled.

For a request submitted by email, these effects occur after the request has been verified and erasure has been initiated, rather than upon receipt of the email alone.

The Operator will remove your profile and video introduction from the Platform and video storage no later than 10 working days after submission of the request.

The procedure for submitting a request, the scope of personal data erasure, retention in backups and exceptions to erasure are governed by the section of the Privacy Policy on candidate account deletion.

10.2 Inactive accounts

If you do not sign in to your account for 24 months, the Operator may delete your account and erase the data in accordance with the procedure in Article 10.1.

Article 11 – Restriction and termination of access

11.1 Grounds for restricting or terminating access

The Operator may temporarily restrict a candidate’s access to the Platform or delete the account, in particular if the candidate:

  • repeatedly or seriously breaches these Terms or applicable law;
  • provides false, incomplete or misleading information material to use of the Platform;
  • does not meet the age requirement, has not completed compulsory schooling or has falsely confirmed their entitlement to work in the Czech Republic;
  • impersonates another person, creates an account for a third party without their authorisation or allows another person to use their account;
  • uploads content that seriously infringes third-party rights, is manifestly unlawful or may jeopardise the safety of other persons;
  • disrupts the security, availability or proper functioning of the Platform;
  • repeatedly provides manifestly illegal content or repeatedly and abusively submits manifestly unfounded notices or objections.

11.2 Operator’s procedure

Where the nature of the breach warrants it and it is proportionate, the Operator will ask you to remedy the breach and set a reasonable time limit before restricting access or deleting the account. A prior request is not necessary where immediate action is required to protect other users, secure the Platform, fulfil the Operator’s legal obligations or avert impending serious harm.

We will inform you of the restriction or termination of access and the reasons for it by email or push notification, unless disclosure of the reason is prohibited by law or a decision of a competent authority, or would undermine the protection of the security of the Platform or third parties.

You may submit an objection to a decision restricting access or deleting an account in accordance with the procedure in Article 6.4 of these Terms.

Article 12 – Contact points

The Operator’s contact point for both users and competent authorities is info@pitchty.com.

Article 13 – Changes to the Terms

The Operator may make reasonable changes to these Terms, in particular because of changes in law, the technical or functional development of the Platform, changes to security measures, expansion or restriction of Platform functions, changes to moderation processes, protection of the rights of users or third parties, or changes to the Platform’s business model.

We will notify you of each change reasonably in advance, at least 30 days before it takes effect, by email or an in-app notice. If you continue to use the Platform after the period specified for the changes to take effect has expired, you are deemed to agree to the changes. If you do not agree to the changes, you have the right to delete your account before they take effect.

If a change adversely affects your access to or use of the Platform to more than a minor extent, we will notify you reasonably in advance of the nature of the change, the date it takes effect and your right to terminate the agreement free of charge by deleting your account. You may exercise this right within 30 days of being notified of the change or of the change occurring, whichever is later.

We are not required to observe the notice periods in the preceding paragraphs where an immediate change is required by law, to protect the security of the Platform, to protect users or third parties, or to avert imminent harm. In that case, we will inform you of the change and the reason for it without undue delay.

Article 14 – Governing law and jurisdiction

These Terms are governed by the law of the Czech Republic. The courts of the Czech Republic have jurisdiction over any disputes between candidates and the Operator. A user acting as a consumer also has the right to contact an alternative dispute resolution body for consumer disputes – the Czech Trade Inspection Authority (www.coi.cz).

Article 15 – Final provisions

If any provision of these Terms becomes invalid, ineffective or unenforceable, the validity, effectiveness and enforceability of the remaining provisions are unaffected.

These Terms take effect on 1 October 2026. The current version of the Terms is always available on the Platform’s website.
